Kyle Harris branded an admin worker a ‘pillock’ before making the cruel earthquake remark
An NHS radiographer has been struck off after he told an admin worker that he hoped they got ‘swallowed by an earthquake’.
Kyle Harris became irate with an admin worker because of slow responses to his email and branded them a ‘pillock’ before making the cruel earthquake remark.
He made a series of other insults and said that he hoped an earthquake struck their office ‘with you in it’.
Mr Harris, based in England, was attempting to re-join the medical register in New Zealand at the time.
He has now been struck off the medical register in Britain.
The Health and Care Professions Tribunal Service [HCPTS] in Britain heard Harris was a registered radiographer in the UK but had previously registered in New Zealand between September 2010 until he was removed in December 2020.
The reason for his removal was that he had allowed his registration to lapse and he had not sought to renew it.
In May 2023 he contacted the Medical Services Secretariat (MSS) indicating that he wished to rejoin the New Zealand register as a radiographer.
As part of the process he had to submit certain documents and claimed that he had not been subject to any disciplinary proceedings – even though he had been twice since leaving New Zealand.
He had been employed as a Band Five radiographer by County Durham and Darlington NHS Foundation Trust from June 2012 until he was sacked for gross misconduct in June 2014.
He was later employed by Gateshead NHS Foundation Trust from August 2017 as a Band Five, and later Band Six, radiographer in the MRI department until he was sacked for gross misconduct in August 2023.
In January 2024, during the restoration process in New Zealand, MSS staff missed that he had provided a form. On email he told them: “I give up. You make it impossible. Cancel everything and refund my money.”
He later emailed HR saying: “You guys really are a bunch of dickheads.”
After being warned that that language was ‘totally unacceptable’ he greeted a colleague by saying ‘hey douchebag’.
He then criticised the service in an email saying: “It takes literally a week to get a reply and it’s some pillock who asks for something I have already provided. Shite behavior [sic], shite service from Shite people at nzmrt.
“It’s nice that your inclusive, but obviously you aren’t mentally competent to understand f*** off. So maybe ask your carer to explain. Stop messaging me.
“I hope the earthquake shallows (sic) your office with you in it.”
After being told that his messages would be referred to the professionals standard process, in March 2024 he replied saying: “My response is you can go f*** yourself.”
The HCPTS struck him off the UK register.
During communications with the HCPTS in relation to the hearing, he said: “Stop messaging me with your little problems. I really don’t care.”
The chair of the hearing said: “The Panel determined that that [Mr Harris’] conduct found proved was serious and wide ranging, involving making inappropriate comments, deliberately providing inaccurate information to a Regulator and dishonesty.
“The inappropriate comments set out took place on three occasions to three different colleagues over a period of around three months.
“The Panel considered that [Mr Harris’] conduct in making inappropriate comments was attitudinal and potentially could be reflected in his interactions with service users with a potential consequent risk of emotional and other harm.
“The Panel has concluded that [Mr Harris’] dishonest conduct was a deliberate attempt to withhold information that could have adversely affected his restoration application and had the potential to give rise to a risk of harm to service users.”
